These general terms and conditions of sale (the "Conditions") govern the purchase of SailSensor products through the website www.sailsensor.it. By placing an order, the Customer declares that they have read and fully accepted these Conditions.

The SailSensor brand and products belong to Moxá Design, which carries out the sale through this website. CarveLab is a partner/distributor of the project.
SailSensor products are pressure-sensor systems for sailing, comprising hardware components, a proprietary app and, in the PRO plans and bundles, a subscription cloud service for data collection and analysis. The essential features of each kit are set out on the SailSensor kit and Order pages.
Images and descriptions are for illustrative purposes only; minor differences from the actual product, due to the custom-made configuration, do not constitute a lack of conformity.
Each SailSensor kit is custom-made: it is assembled, configured and calibrated according to the specific boat and sail to which the system is applied (number and arrangement of sensors, boom-sensor options and NMEA 2000 interface, calibration). The data provided by the Customer at the time of ordering is used to personalise the product.
All prices shown are expressed in Euro and are inclusive of VAT. Any shipping costs, where applicable, are indicated before the order is finalised. The Seller reserves the right to modify prices at any time; the price published at the time the order is submitted applies to the Customer.
The Customer selects the kit, completes the required details, gives the mandatory consents and proceeds to pay the deposit. The contract is deemed concluded at the time of confirmation of payment of the deposit (for PayPal/card) or upon submission of the order with bank transfer selected, followed by confirmation from the Seller by email.
The order requires payment of a 30% deposit of the price at the time of ordering; the 70% balance is due upon dispatch/delivery. The following methods are accepted:
The invoice is issued by Moxá Design. The Customer is required to provide correct details for invoicing.
The estimated delivery time is normally within 30 days of order confirmation and receipt of the deposit, unless otherwise indicated. Delivery times are indicative; any delays do not give rise to a right of cancellation if they remain within the limits of the law. The risk of loss or damage to the goods passes to the consumer Customer upon physical delivery of the goods.
Pursuant to art. 59 of the Italian Consumer Code (Legislative Decree 206/2005, implementing EU Directive 2011/83), the right of withdrawal does not apply to SailSensor orders, because:
At the time of ordering, the Customer expressly confirms the custom-made configuration and, where applicable, requests the immediate activation of the digital service, acknowledging the exclusion of the right of withdrawal. For Customers purchasing within their professional activity (with a VAT number), the consumer rules on withdrawal do not apply in any case.
For consumer Customers, the 24-month legal guarantee of conformity under Articles 128 et seq. of the Italian Consumer Code always remains valid. In the event of a lack of conformity, the Customer is entitled to have conformity restored (repair or replacement) and, in the cases provided for, to a price reduction or termination of the contract. Use of the proprietary app and the cloud service is subject to the relevant terms of use and the privacy notice. The PRO subscription has the duration indicated at the time of ordering; unless otherwise stated, it does not renew automatically. The continuity of the cloud service may depend on technical factors (connectivity, scheduled maintenance).
The SailSensor system is protected by patent and by the intellectual property rights of Moxá Design. Trademarks, content, software and documentation may not be reproduced without authorisation. The purchase of the product does not entail any transfer of intellectual property rights.
SailSensor is a tool to support the reading of sail trim: it does not replace the experience or judgement of the sailor, nor the on-board safety equipment. The Seller is not liable for damage arising from improper use of the product or from failure to follow the instructions.
Personal data is processed in accordance with the Privacy Policy and the Cookie Policy.
These Conditions are governed by Italian law. For consumer Customers, the court of jurisdiction is that of the consumer's place of residence or domicile. The consumer may also use the European Commission's online dispute resolution (ODR) platform: ec.europa.eu/consumers/odr. For professional Customers (with a VAT number), the court of jurisdiction is that of Modena.
