This page explains how the right of withdrawal and the legal guarantee apply to purchases of SailSensor kits. The seller is Moxá Design, which issues the invoice and handles any refunds and support.
Every SailSensor kit is a custom-made product: it is assembled, configured and calibrated for the specific boat and the sail on which the system is fitted (number and arrangement of sensors, boom sensor and NMEA 2000 interface options, calibration). The system also includes the proprietary app and, on the PRO plans and bundles, the subscription cloud service for data collection and analysis.
Under art. 59 of the Italian Consumer Code (Legislative Decree 206/2005, implementing EU Directive 2011/83), the right of withdrawal does not apply:
When placing your order you are asked to expressly confirm the custom configuration and, for the cloud service, to request its immediate activation, acknowledging the exclusion of the right of withdrawal.
For consumers, the 24-month legal guarantee of conformity provided for by Articles 128 et seq. of the Italian Consumer Code always remains valid. In the event of a lack of conformity you are entitled to have conformity restored (repair or replacement) or, in the cases provided for, to a price reduction or to termination of the contract.
If the product arrives damaged, defective or not as ordered, contact Moxá Design: we will act in accordance with the terms of the law. This is a right that is distinct from and independent of the right of withdrawal.
